In consideration of using “ICF Pro-Link” (“Pro-Link”), I hereby agree with Logix Insulated Concrete Forms Ltd. (“Logix”) as follows:

• DISCLAIMER OF WARRANTIES: The information provided through Pro-Link is provided on an “as is” basis and without warranties of any kind either express or implied. By accessing and using Pro-Link, I acknowledge and agree that Logix and its successors, assigns, predecessors, affiliates, directors, officers, employees, representatives and agents (collectively, the “Released Parties”) has made no representation or warranty with respect to the fitness, quality, or suitability of any of the construction professionals listed on the Pro-Link (“Professional” or “Professionals”), including without limitation, that a particular Professional will be suitable for a particular purpose. Logix is not responsible for any work undertaken by the Professionals, and any services obtained through Pro-Link are solely at my own risk. Logix disclaims any responsibility or liability for the fitness, quality or suitability of any work undertaken by the Professionals. To the fullest extent permissible pursuant to applicable law, Logix disclaims all warranties, express or implied, with respect to the fitness, quality or suitability of the Professionals.
• LIMITATION OF LIABILITY: Under no circumstances shall I be entitled to recover any special, incidental, consequential or indirect damages from the Released Parties which the I may suffer arising out of, caused by, or in connection with, the use of Pro-Link and any services obtained from a Professional through Pro-Link, whether arising in contract, tort, in equity, at law or otherwise.
• RELEASE: I waive, release, and renounce all my rights, express or implied, against Logix, arising by law or otherwise, from any claims, actions, demands, costs and expenses of any kind whatsoever, whether in contract, negligence or tort, at law or in equity, or by statute or otherwise, howsoever caused, with respect to my use of Pro-Link and any services obtained from a Professional through the Pro-Link, including without limitation, any defect in any work undertaken by a Professional.
